What happens in Mediation?
In mediation, a trained mediator discusses the case with both sides in private and work to find a solution that is beneficial and acceptable to all parties involved. While the goal of mediation is to settle, mediation is about compromising. The joy of mediation is that you get to decide instead of a judge that does not know you or your family!
Your time in mediation may range from four to eight hours depending upon the complexities of your family law matter. The mediator is paid a separate fee by one or both parties. If you can settle your case in mediation, the mediator will draft an irrevocable Mediated Settlement Agreement which is signed by all parties and their attorneys. If you are unable to reach an agreement in mediation, the mediator will declare an impasse and the parties will proceed to court to allow a judge to resolve the conflict.
